What is a Class 3 FFL Dealer (NFA Dealer)?
These dealers have first obtained an FFL License and then upgraded their license by applying for and being approved for an SOT (Special Occupational Tax) License. In simplest terms, FFL + SOT = Class 3 Dealer. The SOT allows the dealer to purchase Class 3 weapons without incurring the $200 tax.
How do I purchase a Class 3 Weapon (Type II Firearm)?
First, find a local Class 3 dealer in your state and ask about legality and availability of firearm desired. You technically cannot start the Class 3 process until you have identified the firearm you wish to purchase; the ATF paperwork is serial number specific. Many consumers incorrectly believe they must first apply for a “Class 3 License” before they are allowed to purchase a Class 3 weapon. The Class 3 dealer will help you complete a Form 4, which allows the NFA Branch of the ATF to review your background and transfers the firearm (serial number specific) from your Class 3 dealer to you.
